TYPES OF CASES

DISCRIMINATION

Different treatment or termination because of a “protected characteristic” such as race, sex, disability, age, sexual orientation, gender identity, national origin, veteran status, or religion.

WRONGFUL TERMINATION

Termination for an illegal reason. In most cases, the termination is motivated by the employee’s protected activity, such as reporting something that is illegal, like a whistleblower, taking protected medical leave, like FMLA, or because of a protected characteristic, such as race, sex, disability, age, etc.

HARASSMENT

Harassment includes the commonly known quid pro quo sexual harassment as well as harassing conduct at work that is motivated by someone’s protected characteristic, such as sex, race, age, religion, etc..

UNEQUAL PAY

California requires equal pay for substantially similar work, no matter a person’s sex or race.

COMMISSION DISPUTES

An employee who has performed all the work necessary to earn a commission or bonus is generally entitled to payment for their work.

MEDICAL LEAVE

Many employees are entitled to 12 weeks of protected leave of absence to care for their own serious medical condition or that of a family member. A company may not fire someone for taking protected medical leave.

RETALIATION

Employees in California who object to their employer’s unlawful or discriminatory conduct are protected from retaliation.

PARENTAL LEAVE

An employer may not discourage an employee from taking protected leave to care for a newborn or recently adopted child, or retaliate against someone for taking maternity or paternity leave.
